VISA WAIVER PROGRAM BOARDING AUTHORIZATION
A Visa Waiver Program traveler generally needs approved ESTA authorization before boarding a carrier for VWP travel to the United States. If ESTA shows “Travel Not Authorized,” the traveler cannot simply use the Visa Waiver Program for that trip.
CBP explains that ESTA determines whether a Visa Waiver Program traveler is authorized to travel to the United States under the VWP.
ESTA approval allows the traveler to seek transportation and admission under the VWP; it does not guarantee admission after CBP inspection.
CBP states that a traveler whose ESTA result is “Travel Not Authorized” is not authorized to travel to the United States under the Visa Waiver Program.
CBP advises travelers denied ESTA who still wish to travel to apply for an appropriate nonimmigrant visa through a U.S. Embassy or Consulate.
An ESTA denial is not automatically the same as a finding that the person can never receive a U.S. visa.
Current CBP guidance specifically warns that reapplying for ESTA with false information in an attempt to qualify can create serious additional consequences.
CBP states that a new ESTA application is required in specified circumstances, including issuance of a new passport, a change in citizenship or certain changes affecting eligibility.
CBP notes that DHS TRIP is available as a redress mechanism, but there is no guarantee that a DHS TRIP request will resolve the VWP eligibility issue that caused an ESTA denial.
CBP states that a traveler who possesses a valid U.S. visa for the intended purpose does not need ESTA for travel on that visa.
Not for travel under the Visa Waiver Program. ESTA authorization is required for VWP transportation.
Not necessarily. “Travel Not Authorized” prevents VWP travel but does not itself identify every possible immigration ground that might apply.
CBP states that U.S. Embassies and Consulates cannot provide details about ESTA denials or resolve the ESTA issue, but they can adjudicate a separate nonimmigrant visa application.
These government materials describe the carrier-document, APIS, ESTA and visa rules discussed on this page.
A denied ESTA usually shifts the traveler from Visa Waiver Program travel to the ordinary visa process rather than creating a solution at the airline counter.
