These Terms of Use govern access to and use of Deported at Border, including the website’s immigration information, contact forms, downloadable materials and links.

By accessing or using this website, you agree to these Terms of Use and the Privacy Policy. Do not use the website if you do not agree.

The website provides general U.S. immigration information. It does not replace legal advice based on the facts and records of a specific matter.

No Attorney-Client Relationship

Viewing the website, sending a message, uploading documents or speaking with Firm personnel does not create an attorney-client relationship. Representation begins only after the Firm accepts the matter and a written representation agreement is signed.

1. Agreement to These Terms

These Terms of Use constitute an agreement between you and The Messersmith Law Firm, P.A. concerning your access to and use of deportedatborder.com, including its text, graphics, forms, downloadable materials, links and other content.

You represent that you are legally capable of agreeing to these Terms. A person using the website for an organization represents that the person has authority to bind that organization concerning the use of the website.

2. General Information Only—Not Legal Advice

The website provides general information concerning U.S. border refusals, expedited removal, withdrawal of an application for admission, visa cancellation, inadmissibility, CBP records, Form I-212 and related immigration matters.

Website content is not legal advice and should not be relied upon as a substitute for advice from a qualified attorney who has reviewed the relevant facts, government records, procedural posture, deadlines and current law. Immigration law and government procedures can change, and similar facts can produce different legal results.

Do not take or refrain from taking legal action solely because of information found on this website.

3. No Attorney-Client Relationship

Accessing the website, downloading material, submitting a contact form, uploading a document, sending an email, calling the Firm or receiving a preliminary response does not create an attorney-client relationship and does not obligate the Firm to represent you.

An attorney-client relationship begins only when the Firm has completed any required review, expressly agreed to undertake the representation and entered into a written representation agreement with the client. Until then, you remain responsible for protecting your legal rights and meeting all deadlines.

4. Communications, Conflicts and Confidentiality

Before representation begins, the Firm may need to review information to determine whether it can consider the matter, whether a conflict exists and whether the matter falls within the Firm’s practice. Do not assume that unsolicited information is protected by an attorney-client relationship or that sending information prevents the Firm from representing another person.

Do not send original documents, passwords, full Social Security numbers, complete financial-account information or other unnecessary sensitive information through the website. Electronic communications can be delayed, intercepted, misdirected, filtered or accessed without authorization.

Information submitted through the website is also governed by the Privacy Policy.

5. Deadlines, Emergencies and Time-Sensitive Matters

Do not use the website or an online form to communicate an emergency, imminent travel problem, detention matter, court deadline, filing deadline, response deadline or other time-sensitive issue. A submission may not be reviewed immediately and may be blocked by spam filters or technical problems.

Unless the Firm has accepted a matter in writing, the Firm has no duty to monitor, preserve or meet a deadline on your behalf. You should obtain prompt legal advice from an available attorney when a deadline or emergency exists.

6. Government Decisions, Processing Times and Prior Results

USCIS, CBP, the Department of State, immigration courts and other government authorities control immigration records, processing times, visa decisions, waivers, removal-related determinations and admission to the United States. The Firm does not control those authorities.

No statement on the website guarantees that a record will be released, an order will be corrected or vacated, a waiver will be approved, a visa will be issued or a person will be admitted. Descriptions of prior matters, experience or outcomes do not guarantee a similar result.

References to government forms, filing procedures, fees, addresses, processing times and policies may become outdated. Users should verify current requirements with the responsible agency or qualified counsel before acting.

7. Permitted Use and Prohibited Conduct

You may use the website for lawful personal or business informational purposes. You may not:

Government forms, statutes, regulations and third-party materials remain subject to their respective rights and terms.

You retain ownership of information and documents that you submit. You authorize the Firm and its service providers to receive, store, copy, transmit, review and otherwise process submitted materials as reasonably necessary to respond to the inquiry, evaluate potential representation, protect website security, comply with law and perform services after representation is established.

You represent that you have the right to submit the materials and that doing so does not violate law, confidentiality duties, court orders or another person’s rights. Do not upload privileged or confidential material belonging to another person unless you are authorized to do so.

The Firm does not control and is not responsible for third-party availability, accuracy, security, accessibility, privacy practices or terms. Your use of a third-party service is governed by that provider’s policies and agreements.

11. Website Availability and Disclaimers

To the fullest extent permitted by law, the Firm disclaims warranties of any kind, whether express, implied or statutory, including warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, title, noninfringement, security and uninterrupted availability.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless the Firm and its personnel from third-party claims, liabilities, damages and reasonable costs arising from your unlawful misuse of the website, your violation of these Terms or materials you submit without authorization. This provision does not apply to claims arising from legal services governed by a separate representation agreement.

14. Governing Law and Disputes

To the extent permitted by law, these Terms and disputes arising solely from use of the website are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to any mandatory law, exclusive venue for such a dispute will lie in the state or federal courts located in Orange County, Florida.

This section does not govern a dispute arising from legal representation when a separate engagement agreement, professional rule, statute or other law supplies a different rule.

15. Severability, Waiver and Entire Agreement

If a provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. These Terms and the Privacy Policy constitute the agreement concerning general website use, but do not replace a signed representation agreement or another written agreement governing a separate service.

16. Changes to These Terms and Contact Information

The Firm may revise these Terms to reflect changes in the website, services, law or business practices. Revised Terms become effective when posted unless a later date is stated. Continued use of the website after revised Terms are posted constitutes acceptance of the revised Terms.
