The same Immigration and Nationality Act can apply at airports and land ports, but the evidence, procedures and practical consequences can differ depending on where the traveler seeks admission.
Whether the traveler arrives by airplane, vehicle or on foot, a noncitizen seeking entry must establish eligibility for the admission requested and must not be inadmissible under an applicable statutory ground.
The location can change the facts without necessarily changing the INA ground. A §212(a)(6)(C)(i) finding, for example, remains a misrepresentation finding whether it arises at an airport or land port.
At an international airport, CBP generally conducts primary inspection after arrival, with travelers referred to secondary inspection when additional review is necessary.
